Unless, you are selling off the car when upgrading to a new car or when you are transferring the ownership of your car to your loved one, it is now mandatory requirement by JPJ under new mySIKAP system effective 1st June, 2014 for both the owner and buyer or the new owner to be present at JPJ’s office personally to transact online using the bio-metric features to identify the owners and prevent fraud, you are required to cancel your road tax first before you can cancel your car insurance policy online with the insurance company and JPJ.
Therefore, when you you do not cancel your road tax when transferring the ownership if the period of insurance of your existing car insurance policy remaining is more than four (4) months, you will not be entitled to refund of insurance premium from your insurance company.
To cancel your car insurance policy, you must cancel your car road tax online with JPJ which will require you to surrender the physical sticker road tax which you stuck on your windscreen earlier. So it is a bit of sticky thing to remove from your car windscreen. To avoid the hassle, many car owners will usually wait till the very last few days before the road tax expiry date to do the transfer of ownership and forego the cancellation of road tax and refund on insurance premium(not entitle if period remaining is less than four months). Sometimes, the reason to let the car insurance policy run on til it expiry is allow the owner to move up to the next level of No Claim Discount (NCD) entitlement, i.e. if it is from 45% level to 55% level (Maximum).
In the above situations, the new owner of the car will benefit from the generosity of the seller or previous owner since he/she get to enjoy the road tax remaining span. As car insurance agent, we will usually accommodate the client’s request to purchase the new insurance for the used car to allow him/her to also renew the road tax for one year by issuing the car insurance cover note or policy online to include one year term plus the remaining span of the existing road tax overlapping period so that the renewal of car insurance policy date and the renewal of car road tax date can be coincided with the next anniversary date of renewal of the existing car road tax.
Example 1: Car owner A transfer to new owner B on 27th November, 2014 at JPJ office. A’s car insurance policy and road tax are expiring only on 30th November,2014. A does not want to cancel his/her road tax on 27th November, 2014, but will let his/her insurance policy to run on until it expires on 30th November, 2014.
Therefore, after the car has been pre-inspected by PUSPAKOM, the new owner B can instruct his/her car insurance agent to issue a new policy for the insuring period from 27th November, 2014 to 30th November, 2015 which is exactly one(1) year four (4) days. The calculation of motor insurance premium will be pro-rated and based on the sum insured at the prevailing market or agreed value of the vehicle model.
Sometimes, the client need to get it done fast and the seller and owner could not confirm when during the week they will be free to go to JPJ to transfer the ownership, it gives rise to another solution.
Example 2: Based on the same situation of Seller A and Buyer B going to JPJ on 27th November, 2014 to transfer. If B had asked insurance agent to issue a car insurance policy on 20th November, 2014, the agent will simply issue an annual car policy for 12 months from November 24, 2014.
Since the road tax is expiring on 30th November, 2014, the new policy purchased by B is only valid till 23rd November, 2015. Therefore, JPJ will only allowed him/her to renew the road tax for six (6) months period from 1st December, 2014 to 31st May, 2015 since the new one year road tax will require him/her to have a policy valid till 30th November,2015.
So, if B already renewed the road tax till 31st May, 2015, he will need to extend the period of insurance from 24th November, 2015 to 30th November 2015 by four (4) days when he/she wants to renew the road tax for another six(6) months period from 1st June 2015 to 30th November, 2015.
Note: JPJ allows road tax renewal of 6 months or 12 months only. Many years ago, JPJ allowed extension on road tax for the odd days. This practice has stopped more than 10 years ago. For commercial vehicles like lorry , taxi and bus, the road tax renewal can still be done on monthly basis.
For commercial vehicles which usually need to go for PUSPAKOM inspections every six(6) months, there are some issues on tracking the due date for inspection by PUSPAKOM since it can be difference from the JPJ’s road tax due date. To avoid the mistaken dates, it is best for the clients with company’s commercial vehicles to list them in their diary or listing on white board of important dates for ease of tracking. Also, it is best for them to renew the road tax for 12 months instead of 6 months to minimise the tracking.
